I. Overview
(A) Purpose:
To regulate the business conduct of merchants using the Voghion platform (hereinafter referred to as “Voghion” or the “Platform”), create a legal and compliant business environment, protect the legitimate rights and interests of consumers, promote the healthy and sound development of operators within the platform, and maintain the operational order of the platform. These rules are established in accordance with relevant national laws and regulations, regulatory bodies, various agreements between the platform and merchants, as well as other rules and management measures published by the platform.
(B) Prohibition of Publishing Prohibited Products:
Voghion platform strictly prohibits merchants and users from publishing or selling any products whose sale is prohibited by relevant national laws and regulations (including but not limited to the laws of the sales destination, merchant location, buyer location, etc.), as well as publishing products prohibited under merchant service agreements, Voghion platform rules, and any products without authorized operating qualifications.
(C) Scope of Application:
These rules apply to all merchants on the platform.
II. List of Prohibited or Restricted Products/Information for Sale
The following list outlines several categories of prohibited or restricted products and related information, but it is not exhaustive. Merchants and their affiliates are responsible for ensuring compliance with any applicable laws and requirements in any jurisdiction. The platform will update this policy periodically as necessary. Merchants are advised to regularly visit this page to stay informed of relevant updates.
The platform does not guarantee the completeness, timeliness, or accuracy of prohibited or restricted sale information. The final authority rests with the current effective laws and regulations of the exporting and destination countries, as well as the latest announcements and policies published by the platform.
Categories of Products/Information
Prohibited Products/Information for Sale (Including but Not Limited to the Following):
(A) Drugs, Precursors, and Drug-Related Tools
• Narcotics, psychotropics, natural drugs, synthetic drugs, Category I precursors;
• Category II precursors, steroids;
• Category III precursors;
• Tools and accessories for drug consumption or injection;
• Tools aiding in the smuggling, storage, sale, transportation, manufacturing of drugs;
• Methods of drug manufacturing, books, and all other drug-related goods and information.
(B) Flammable, Explosive, and Hazardous Chemicals
• Explosives and initiation devices;
• Flammable and explosive chemicals;
• Radioactive materials;
• Ultra-toxic chemicals;
• Toxic chemicals;
• Ozone-depleting substances;
• Asbestos and asbestos-containing products;
• Fireworks, firecrackers, and related accessories.
(C) Firearms, Control Devices, Military and Police Equipment
• Weapons of mass destruction, real firearms, ammunition, military equipment, and related accessories;
• Firearms, firearm accessories, and related equipment;
• Replica firearms and their components;
• Only toy firearms made of plastic or soft materials with muzzle energy below the recognition standards for replica firearms (1.8 J/cm²) may be published;
• Potentially threatening crafts;
• Controlled knives, bow and crossbow accessories, batons, darts, axes, blowguns, blood trough knives, blade handheld devices, and disguised knives that may be used to harm others’ personal safety and/or render others temporarily incapable of resistance, causing significant bodily harm;
• Uniforms and accessories for military, police, and other government agencies, including but not limited to:
1. Uniforms and accessories for military, police, and other government agencies, as well as their replicas, large emblems, and their replicas;
2. Prohibition of selling security clothing, security tools, etc., highly similar to police uniforms and equipment;
3. National emblems, party emblems, police emblems, customs, tax, and other emblems hung by national agencies.
(D) Harmful Information Threatening National Security, Political and Social Stability
• Products or information containing elements of secession, destruction of national unity, threats to national security or interests, political destabilization, incitement to subvert the national regime, overthrow the socialist system, or disclosure of state secrets;
• Products or information promoting terrorism, extremism, inciting ethnic hatred, racial discrimination, destroying national unity, violating national religious policies, promoting cults, harming ethnic/religious sentiments, using religion’s name for commercial advertising or proselytism;
• Products or information damaging national honor or reputation, distorting, denigrating, profaning, or negating heroic and martyr acts and spirits, beautifying foreign invasion facts, or promoting militaristic ideologies;
• Products or information disseminating or evaluating national policies, national leaders, political events, social events, religious activities, etc.;
• Controversial or sensitive products contrary to morality, fundamental human principles, and public order;
• Including but not limited to abortion tools, genetic-related products, animal or organ cloning-related products, products that may harm the environment or society;
• Products or information harming the physical and mental health of minors;
• Other politically charged information, etc.
(E) Pornographic, Violent, Vulgar, and Aphrodisiac Products
• Information related to bestiality, sexual abuse, incest, rape, and child pornography;
• Books, comics, audiovisual materials, videos containing explicit pornographic, obscene, or violent content, as well as services related to pornography;
• Pornographic products for minors and products or information harmful to the physical and mental health of minors;
• Products containing representations of real nudity, genital organs, sexual acts, violent or sexual movements, images;
• Promotion of vulgar, violent, obscene, or pornographic language;
• Original-flavored products, including but not limited to original-flavored underwear, socks, handkerchiefs, and all other original-flavored products;
• Online vulgar products: displaying or describing nudity, genital organs, sexual behavior, women’s under-the-skirt actions, or other nudity behaviors;
• Aphrodisiac products that can cause others to become temporarily unable to resist or unconscious, including oral or topical aphrodisiac products, artificial virgin membranes, and entertainment accessories such as “Triazolam,” “Fly Powder,” “Fly Water,” etc.
(F) Equipment for Illegal Income and Illegal Use
• Software and equipment used for eavesdropping, stealing privacy or secrets;
• Signal jammers;
• Illegal software and hacking products;
• Equipment used for illegal filming, recording, evidence collection, etc.;
• Illegal use tools (such as theft tools, lock-picking tools, bank card copiers);
• Decoders or other equipment for accessing content requiring authorization (such as satellite signal receiving/transmitting devices and software, HDMI keys);
• Counterfeit and imitation products, fakes, etc.
(G) Illegal Services
• Documents, certificates, official seals, medals issued by government agencies, ID cards, and other identification documents, tools, main materials, and methods for forging or altering relevant documents;
• Documents, tickets, seals, emblems of government and specialized agencies;
• Financial documents, bank cards, tools, main materials, and methods for forging or altering relevant documents; money laundering, illegal transfers, illegal fundraising, illegal tax evasion;
• Personal private information and internal corporate data; services for personal phone location, call list searches, bank account searches, etc.;
• Legal consulting services, lottery services, medical services, educational certificate processing services, etc.;
• Debt collection services, artificial follower or audience increase services, visa services;
• Gambling, betting products and services, online gambling information, etc.;
• Products or services that may infringe others’ intellectual property rights and other legitimate rights.
(H) Human Organs, Hunting Tools, Protected Live Animals and Plants
• Human skeletons, organs, bodily fluids, plastinated human specimens, including but not limited to organs/cadavres/sperm/eggs/blood, plastinated human organs, and other specimens made from human organs or cadavres;
• Protected and endangered live animals, body parts; public protection animals (sharks, bears, cats, dogs, etc.); animal hunting equipment and accessories (plastination services, skinning services; electric traps; animal traps; hair removal machines for cats and dogs); products derived from these animals;
• Protected and endangered plants, regional protected plants, protected plant specimens, and other plant-based products;
• Plant seeds;
• Live animals and plants and their products.
(I) Medicinal Products
• Prescription drugs, steroids, psychotropic drugs, radioactive narcotics;
• Toxic medicinal herbs, fake drugs, substandard drugs, and other prohibited medicinal products for sale;
• Oral medications and health supplements containing prohibited ingredients, such as weight loss pills and health supplements;
• Over-the-counter drugs, etc.
(J) Medical Devices
• Medical consultation and medical services as well as equipment related to pharmaceutical manufacturing;
• Restricted sale of medical devices;
• Class I medical devices;
• Class II medical devices;
• Class III medical devices;
• The platform restricts the publication of medical devices without relevant compliance certification from exporting and selling countries;
• Veterinary medical devices;
• Restricted sale medical devices, prohibition of publishing unauthorized medical devices, etc.
• Provide production and sales licenses/certifications certified by relevant exporting and selling countries; authorized medical devices can be published after platform approval.
(K) Cosmetic Products
• Cosmetics containing ingredients prohibited by the US FDA;
• Products that do not meet the compliance requirements of exporting and destination countries;
• For example, special cosmetics that are both cosmetics and OTC drugs sold in the US without FDA registration and GMP certificates from the manufacturing company, etc.
(L) Collectibles, Currencies, Nationally Protected Relics, Fossils, and Other Collectibles
• Currencies, financial tickets, main materials, tools, and methods explicitly or implicitly used for counterfeiting or altering currencies and financial tickets;
• Virtual currencies (such as Bitcoin);
• Gold, silver, and other precious metals (excluding jewelry);
• Nationally protected relics, antiques, fossils, and other collectibles;
• Protected and endangered live animals and plants and their products;
• Plant seeds;
• Live animals and plants and their products.
(M) Products Involving Legal Violations or Unsuitable for Trade
• Unauthorized licensed products for the Olympic Games, World Expos, Asian Games, etc.;
• Widely circulating currencies of various countries and currency exchange services;
• Postal parcel documents, EMS express delivery, courier express service documents, and tracking numbers;
• Alcoholic products, including but not limited to baijiu, red wine, beer, wine, etc.;
• Manufactured cigarettes and tobacco products;
• E-cigarette liquids;
• E-cigarette devices, components, and accessories;
• Some national sites may sell, merchants must obtain platform category operating permissions and comply with current effective laws and regulations of exporting and destination countries;
• Products distributed freely or subsidized by the government that cannot be privately transferred;
• Products reserved for the military, government, or special supplies, etc.;
• Radio stations (stations);
• Gift cards, discount coupons;
• Lottery tickets, event tickets, admission tickets, etc.;
• Other digital virtual content, services, discounts, non-physical products, etc.;
• Any product unsuitable for trade between exporting and destination countries.
(N) Products Non-Conforming to National/Domestic Quality Technical Regulations/Legislation/Standards, Substandard, or Risky Products
• Products recognized, published, or recalled by authorized quality inspection departments or manufacturers; products banned or discontinued for sale by various countries; expired, ineffective, deteriorated products, products without production dates, without shelf life, without manufacturers;
• High-risk and safety hazard products;
• Products recalled by regulatory agencies or government organizations;
• Sanctioned and other regulated products, the platform prohibits the publication of products sanctioned by the United Nations or countries such as China, the United States, etc., in accordance with the laws and regulations of the relevant countries.
(O) Prohibited or Restricted Products for Sale According to Some Countries’ Laws and Unsuitable for Cross-Border Sale Due to Product Attributes
• Products prohibited or restricted from listing or selling according to regulations of certain countries, prohibited from listing or selling;
• Prohibition of selling products like “lucky bags,” “blind boxes,” etc.;
• Food and beverages;
• Restricted sale except for some permissible national sites, merchants have obtained platform category operating permissions and comply with all relevant current effective laws and regulations of exporting and destination countries;
• Products unsuitable for cross-border sale due to product attributes, also prohibited from listing or selling.
(P) Other Prohibited Products
• Products deemed unsuitable for sale by the platform based on market, relevant laws and regulations, etc., including but not limited to products violating national/domestic quality technical regulations/legislation/standards; products violating national/domestic quality technical regulations/legislation/standards and any products subject to age restrictions under relevant laws;
• Products manufactured by unqualified manufacturers or not meeting mandatory industry, local, or sectoral standards of the buyer’s and/or seller’s jurisdiction countries, including but not limited to missing product certification standards qualifications, such as medical devices produced in China without domestic Class II/III device registration numbers (mandatory); medical devices intended for the US market without relevant US FDA registration and certification, etc.;
• Products published without obtaining platform category operating permissions, unauthorized product publications, etc.
III. Sanctions and Violation Management
Merchants who violate any provisions under these rules as well as the user agreements published by the Voghion platform and all rules, announcements, etc., already published or potentially to be published by Voghion, Voghion has the right to independently and/or notify our affiliated companies, relevant partners to merchants/merchant stores, and based on the severity of the violation, take disciplinary measures including but not limited to the following violation handling measures:
(A) Violation Handling
1. Disciplinary Measures:
1.1. Partial or complete delisting of products, prohibition of sales, deletion, blocking, downgrading, removal of resource positions, prohibition of resource positions, removal of advertisements;
1.2. Deletion or blocking of prohibited information;
1.3. Prohibition of creating new products or listing products;
1.4. Closure or restriction of certain or all merchant account functions and permissions (including withdrawal functions);
1.5. Restriction of partial or complete fund withdrawals from merchant accounts;
1.6. Require merchants to modify or delete corresponding products or information within a specified time limit and conduct self-inspection of other products;
1.7. Require merchants to compensate Voghion, buyers, or other third parties for all incurred losses;
1.8. Termination of agreements, end of cooperation, and removal of merchants;
1.9. Other disciplinary measures stipulated in the merchant service agreement and/or Voghion merchant rules.
2. Sanctions for Severe Violations:
To eliminate adverse effects and maintain the operational order of the platform, Voghion has the right to punish behaviors that violate relevant laws and regulations or these rules based on reasonable judgment. Regarding violation handling measures, the platform has the right to mitigate or aggravate relevant actions based on the merchant’s behavior and the risk associated with products and information.
3. Legal Responsibilities and Compensation:
The platform has the right to take appropriate legal actions against non-compliant merchants and, in accordance with laws and regulations, retain relevant information to report to concerned departments or transfer to relevant administrative or judicial authorities, etc. If merchants violate laws, regulations, platform standards, and relevant agreements, causing Voghion to suffer losses, face claims from buyers or other users, third parties, or administrative sanctions, merchants shall be responsible for compensating Voghion for the losses. This includes but is not limited to penalties or compensation amounts that Voghion is obligated to pay to any third parties, refunds, penalties or compensation amounts that Voghion pays to buyers on behalf of merchants, amounts of administrative sanctions that Voghion pays, attorney fees paid by Voghion, and necessary expenses to eliminate the impacts. Merchants must bear all legal and compensation responsibilities arising from this independently, and Voghion reserves the right to pursue legal responsibilities of the merchants.
(B) Management Standards:
The platform prohibits publishing any information containing or describing prohibited or restricted sale products and information. Merchants must not circumvent these rules, other prohibited regulations published by the platform, or the content of announcements. Otherwise, they may face aggravated penalties. Additionally, the platform will conduct random inspections of store product information; if involved in prohibited sales, the platform will apply relevant penalties according to the prohibited sales violation rules.
IV. Final Provisions
(A) Modification of Rules:
The platform reserves the right to modify, supplement, or update the content of these rules and announce such changes through the merchant portal, platform announcements, etc., before they come into effect. Once these announcements are made, they are considered as separately notified to each merchant using Voghion’s services. If merchants continue to use Voghion’s services after the announcement of modifications, supplements, or updates to these rules, it is deemed that merchants agree to comply with the modified, supplemented, or updated rules.
(B) Compliance with Laws:
Merchants are obligated to ensure that the products they publish do not violate any applicable legal or regulatory requirements in any jurisdiction.
(C) Authenticity of Provided Documents:
Merchants are obligated to ensure that the images, certificates, quality inspection reports, etc., provided are authentic and valid.
(D) Accuracy of Prohibited Information:
The platform does not guarantee the completeness, timeliness, or accuracy of prohibited or restricted sale information. The final authority rests with the current effective laws and regulations of the exporting and destination countries, as well as the latest announcements published by the Voghion platform.
(E) Adherence to National Laws:
Merchants must comply with national laws, administrative regulations, departmental rules, and other normative documents. For any actions suspected of violating national laws, administrative regulations, departmental rules, etc., if these rules provide provisions, those provisions apply; if these rules do not provide provisions, the platform has the right to handle them at its discretion within the scope permitted by relevant laws and regulations. However, the platform’s actions do not exempt merchants from their legal responsibilities. In all actions by Voghion, all agreements signed with the platform and all rules, announcements, etc., published by Voghion must also be respected.
(F) Responsibility for Compliance:
Merchants are required to ensure that the products they publish do not violate any applicable legal or regulatory requirements in any jurisdiction. For special products, in addition to meeting these standard requirements, they must also comply with relevant rules for those special products.
(G) Final Provisions:
The platform reserves the final right to interpret and decide on these rules and retains all related rights.
(H) Effective Date:
These rules were first published on July 9, 2024, with a public notification period of 7 days. If no modifications are made during this consultation period, they will come into effect on July 16, 2024. In case of modifications, a new announcement will be published separately.
